• Noise complaints that result in a fine under Marloth Park rules will incur a R500 charge, which will be deducted from the refundable breakage deposit only if the fine is actually issued and charged to the owner or management. • Guests must not engage in unlawful, dangerous or disruptive behaviour.
The lead guest is responsible for ensuring that everyone in their group follows these rules. Serious or repeated breaches may result in the stay being terminated.
7. Wildlife, Swimming Pool, Guest Safety and Assumption of Risk
7.1 General Property Use and Personal Responsibility
Thula Thula Guest House is situated in Marloth Park, a bushveld environment where wild animals and natural hazards may be present. Guests should understand that staying in this environment involves risks that may differ from those associated with accommodation in a built up urban area.
Guests use the property, including the house, garden, swimming pool, outdoor areas, amenities and facilities, at their own risk.
Guests are responsible for taking reasonable precautions for their own safety and the safety of those accompanying them, particularly children and other people who may require supervision.
The owners, management and their representatives will not be responsible for loss, injury, illness or damage to the extent that liability may lawfully be excluded or limited. Nothing in these terms excludes liability for negligence or other conduct where such exclusion or limitation is prohibited by law.
7.2 Swimming Pool Safety
THE SWIMMING POOL IS UNSUPERVISED AND IS USED AT THE GUEST’S OWN RISK. THERE IS NO LIFEGUARD OR DEDICATED MEDICAL PERSONNEL STATIONED AT THE POOL.
Swimming involves inherent risks, including drowning, slips, falls and injury. Guests must assess their own abilities and circumstances before using the pool.
Children must be supervised continuously and closely by a responsible adult whenever they are in or near the swimming pool. Children must never be left unattended near the pool, even if they can swim.
Guests should not run around the pool, dive into shallow water or engage in behaviour that may endanger themselves or others. Appropriate care must be taken around wet surfaces and pool edges.
Guests should not use the pool if they believe conditions are unsafe. In an emergency, guests should contact the appropriate emergency services immediately. Immediate assistance or medical treatment cannot be guaranteed.
The owners and management do not accept responsibility for pool related injury, loss or damage to the extent that liability may lawfully be excluded or limited. Nothing in this clause excludes or limits any liability that cannot legally be excluded or limited under South African law.
7.3 Wild Animals and Wildlife Safety
Marloth Park is a wildlife area bordering the Kruger National Park. Animals including giraffe, zebra, kudu, impala, wildebeest, warthog and monkeys may roam freely through the area. Lions, leopards and hyenas have also been reported in the wider area.
All wild animals must be treated as unpredictable, regardless of their apparent calmness or familiarity with people. Animals may cause serious injury or death if approached, startled, cornered or provoked.
Guests must not approach, touch, chase, corner or attempt to interact with wild animals. Guests should maintain a safe distance and follow applicable park rules, warning signs and instructions from relevant authorities.
Feeding wild animals is discouraged and may be prohibited by applicable rules. Guests must not feed animals where prohibited or where doing so may create a danger to people or wildlife. Any unauthorised feeding or interaction is undertaken contrary to these safety instructions and may expose guests to additional risk.
Guests acknowledge that the presence, movement and behaviour of wildlife cannot be controlled or guaranteed by the owners or management. Guests must take reasonable precautions and remain alert at all times.
The owners and management will not be responsible for injury, loss or damage arising from wildlife to the extent that liability may lawfully be excluded or limited. This does not exclude liability that cannot legally be excluded or limited.
7.4 Walking and Movement Within Marloth Park
Guests are strongly advised to remain on designated public roads and clearly marked pathways when walking in Marloth Park.
Guests must not enter neighbouring private properties, gardens, restricted areas or undeveloped land without the relevant owner’s permission or other lawful authority.
For personal safety, guests are strongly advised not to walk in the area before 06:00 or after 18:00, or during darkness or poor visibility, because wildlife may be present and visibility may be limited. Guests must also comply with any stricter rules or directions issued by the relevant authorities.
These times are safety recommendations and do not guarantee that walking at other times is safe. Guests should remain vigilant and use appropriate caution whenever moving around the property or surrounding area.
The owners and management will not be responsible for injury, loss or damage arising from guests choosing to walk or move through the area, to the extent that liability may lawfully be excluded or limited.
7.5 Insects, Spiders, Snakes and Other Natural Hazards
Marloth Park is a natural bushveld environment. Insects, spiders, snakes, scorpions and other potentially venomous or poisonous creatures may be present in or around the property.
Guests acknowledge the possibility of bites, stings, allergic reactions, illness or injury arising from encounters with such creatures or other natural hazards.
Guests should avoid touching or handling unfamiliar animals and insects, take reasonable precautions, and keep doors and windows secured where appropriate. Any suspected dangerous bite or sting should be treated seriously, and medical assistance should be sought promptly.
The owners and management cannot guarantee that the property or surrounding environment will be free of insects, snakes, spiders or other natural hazards. They will not be responsible for resulting injury, illness, loss or damage to the extent that liability may lawfully be excluded or limited. This does not exclude liability that cannot legally be excluded or limited.
7.6 General Guest Safety and Emergency Assistance
Guests are responsible for taking reasonable precautions to protect themselves, their companions and their belongings during their stay.
Guests should secure doors and windows when leaving the property, take care with personal possessions and ensure that children are appropriately supervised throughout the property.
There is no guarantee of immediate medical assistance at the property. In an emergency, guests should contact the appropriate emergency services without delay.
Any incident, injury, damage or safety concern should be reported to management as soon as reasonably possible.
7.7 Acknowledgement of Risks
By booking or occupying the property, guests acknowledge that they have been informed of the ordinary and foreseeable risks associated with a bushveld environment, wild animals, the swimming pool and other natural hazards.
Guests agree to take reasonable care, follow safety instructions and ensure that members of their group, including children, are appropriately supervised.
8. Liability
Thula Thula Guest House, its owners and management are not responsible for loss, theft, injury, illness or damage suffered by guests or their belongings during a stay, except where such responsibility arises from negligence or other conduct for which liability cannot lawfully be excluded or limited.
This provision must be read together with Section 7, which explains the particular safety risks associated with the property, swimming pool, wildlife and surrounding bushveld environment.
Nothing in these Terms and Conditions is intended to exclude, restrict or waive any consumer right, legal duty or liability that cannot lawfully be excluded or limited under the Consumer Protection Act 68 of 2008 or any other applicable South African law.
Guests remain responsible for their own conduct and for taking reasonable precautions to protect themselves, their companions and their belongings.
